Before using the online store  www.alelen.com,  customers are required to read the Terms and Conditions

The seller and owner of the alelen.com Store is Elżbieta Sikorska-Molenda running a business under the name of Naturale Elżbieta Sikorska-Molenda with its registered office in Warsaw (03-140) at ul. Odkryta 27, NIP: 6641544062, REGON: 384266335, registered in the Central Register and Information on Economic Activity (CEIDG), kept by the minister responsible for economy.

 

§1. DEFINITIONS

  1. Store– an online store belonging to the Seller, available at alelen.com
  2. Seller– the company Naturale Elżbieta Sikorska-Molenda with its registered office in Warsaw (03-140) at ul. Odkryta 27, NIP: 6641544062, REGON: 384266335, registered in the Central Register and Information on Economic Activity (CEIDG), kept by the minister responsible for economy.
  3. Client– an adult natural person or a company placing an order in the store.
  4. Regulations– these regulations.
  5. Goods– a movable item, available for sale in a store.
  6. Registration– a one-time activity consisting in setting up an account by the Customer, made using the administrative panel provided by the Seller on the Store’s website.
  7. Order– Customer’s declaration of intent aimed at concluding a contract for the sale of Goods at a distance via the Store, specifying at least the type and number of Goods.
  8. Order Form– a form available in the Store that allows you to place an Order, by adding Goods to the electronic basket and defining the terms of the Sales Agreement, including the method of delivery and payment.
  9. Order Processing Time– the time during which the Order is completed by the Seller and then issued to the carrier; The Order Processing Time does not include the delivery time (the time between the delivery of the Order to the carrier and its release to the Customer);
  10. Business Day– one day from Monday to Friday, excluding public holidays.

§ 2. GENERAL RULES

  1. The Regulations define the rules for the conclusion and performance of the contract for the sale of Goods in the Store and the rules for using the Store.
  2. The Customer may contact the Store by e-mail: biuro@aiduidq.cluster026.hosting.ovh.net, the contact form on the Store’s website and by mail.
  3. In order to use the Store on the Customer’s side, the following minimum technical requirements must be met: a device with Internet access, an installed and updated version of the Internet Explorer, Chrome, FireFox, Opera, Safari with JavaScript and Cookies support enabled, an active e-mail account (e-mail).
  4. All Goods available in the store are new, have no defects and have been legally placed on the Polish market.
  5. The administrator of personal data processed in the Store in connection with the implementation of the provisions of these Regulations is the Seller. Personal data is processed for the purposes, to the extent and based on the grounds and principles set out in the privacy policy published on the Store’s website. The privacy policy contains mainly rules regarding the processing of personal data by the Administrator in the Store, including the grounds, purposes and scope of personal data processing and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Store. Using the Store, including making purchases, is voluntary. The related provision of personal data by the Customer using the Store is voluntary, subject to the exceptions indicated in the privacy policy.
  6. The condition to start using the Store is to read the Regulations and its full acceptance.

 

§ 3. SUBMISSION AND FULFILLMENT OF ORDERS

  1. The customer can purchase goods from the Store’s assortment by placing an order. Orders may be placed twenty-four hours a day, seven days a week:
  2. via the website using the Order Form (Store www.alelen.com)
  3. via e-mail to the following address: biuro@aiduidq.cluster026.hosting.ovh.net
  4. The Store carries out Orders placed from Monday to Friday during the Store’s working hours, i.e. from 9:00 to 18:00. Orders placed on Working Days after 18:00, on Saturdays, Sundays and public holidays will be considered on the next Business Dayafter the day on which the order was placed.
  5. The condition for placing an order is to fill in all the required data needed for shipping in the form, i.e. name, surname, delivery address, e-mail address, contact telephone number. Incorrect completion of the form or providing incorrect data may result in the withdrawal of the Online Store from the implementation of the Order.
  6. Until the selection of Goods is confirmed with the “Buy and pay” button, the Customer has the option of making changes and modifications to the Goods and shipping data. Confirmation of the order by the “Buy and pay” button is tantamount to the obligation to pay the price of the Goods and shipping costs, about which the Customer is informed before confirming the order.
  7. The acceptance of the Order for execution is each time confirmed by the Store by a return e-mail sent to the e-mail address provided by the Customer in the Order Form and is tantamount to concluding a Sales Agreement.

 

§ 4. PRICES AND PAYMENTS

  1. The prices of products in the Store are given in Polish zlotys and are gross prices (including VAT). The prices do not include the costs of delivering the product to the customer, which are given separately.
  2. In the event of a change in the prices of the Goods, the Order will be processed at the price applicable at the time of placing the Order.
  3. The Seller reserves the right to change the prices of goods on offer, introduce new Goods to the Online Store’s offer, remove existing goods from the Store, carry out and cancel promotional campaigns on the Store’s websites or make changes to them, in accordance with the standards of the Civil Code and others and laws. such changes do not violate the rights of persons who concluded contracts for the sale of goods offered by the Store, before the introduction of the above changes or rights of persons entitled to use a given promotion, in accordance with its rules and during its duration.
  4. You can pay for the Goods in the Store according to your choice:
    1. In cash – the customer makes the payment by collecting the goods delivered via the InPost courier company (only Poland),
    2. Fast on-line bank transfer  via Przelewy24.pl or payment card – possible current payment methods are specified on the Store’s website in the information tab on payment methods and on the website http: // www.przelewy24.pl /. The payment card company is PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań New Town and Wilda in Poznań, VIII Commercial Division of the National Court Register under the number KRS 0000347935, NIP 7792369887, Regon 301345068.
    3. By bank transfer directly to the Seller’s account number (bank account number: 78 1050 1054 1000 0097 1905 7193, Owner Naturale Elżbieta Sikorska-Molenda, ul. Odkryta 27, 03-140 Warsaw)
  5. If the Customer chooses the payment method in the form of a prepayment, failure to receive the payment within 3 days of placing the order, will cancel the order.
  6. Consolidation, security and disclosure of essential provisions of contracts concluded by means of distance communication takes place by providing the customer with a proof of purchase. The proof of purchase may be sent in electronic or paper form together with the order.

 

§ 5. SHIPMENT OF GOODS

  1. Goods are shipped within the territory of the Republic of Poland to the address provided by the customer in the order.
  2. If the Customer selects prepayment as a form of online payment, the implementation of the Order begins from the moment the amount in the amount of the sale price (and any shipping costs) is credited to the Store’s bank account. In the case of cash on delivery, the execution of the order begins with the conclusion of the sales contract specified in accordance with § 3 para. 5
  3. Orders are processed on Working Days. Orders placed on Saturdays, Sundays and public holidays are processed on the next business day. The execution time is given with the ordered product and begins when the amount due is credited to the Seller’s bank account or the sales contract is concluded in the case of cash payment.
  4. The date of receipt of the shipment consists of the time of order fulfillment, including the time when funds are credited to the Seller’s bank account (usually up to 2 business days) and the expected delivery time.
  5. The goods are delivered to the address indicated in the territory of the Republic of Poland by the InPost forwarding company or using the “Paczkomaty InPost” service, depending on the option selected by the customer.
  6. Fees for the delivery of products are given in the ordering process and on the Store’s website.
  7. Estimated delivery time is 2-3 business days.
  8. The customer is obliged to inspect the package upon delivery. If the Customer finds that the Product has been lost or damaged during transport, he is obliged to take all steps necessary to determine the liability of the carrier.

 

§ 6. RETURNS OF GOODS – WITHDRAWAL FROM THE CONTRACT

  1. The customer has the right to withdraw from the sales contract without giving any reason within 14 days from the date on which the customer came into possession of the goods or on which a third party other than the carrier and indicated by the customer came into possession of the goods.
  2. In order to exercise the right to withdraw from the contract, the Customer must inform the Store about his decision to withdraw from the contract by means of a declaration sent to the e-mail address biuro@aiduidq.cluster026.hosting.ovh.net (download form  HERE). After receiving such information, the Store will immediately send the Customer a confirmation of receipt of the information on withdrawal from the contract.
  3. The customer sends back the Goods that he wants to return to the postal address:

With the note “RETURN”, no later than 14 days from the date on which he informed the Store about the withdrawal from this contract.

  1. The customer bears the direct costs of returning the purchased Goods.
  2. As part of the return of goods, the Seller does not accept COD shipments.
  3. In the event of withdrawal from the contract, the Store returns to the Customer all payments received by him, including the costs of delivering the Goods, no later than 14 days from the date on which the Store received the returned goods.
  4. The Customer’s payment will be refunded using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agrees to a different solution.
  5. The Customer is responsible for reducing the value of the returned Goods resulting from using them in a different way than was necessary to establish the nature, characteristics and functioning of the goods.
  6. The right to withdraw from a distance contract is not entitled to the Customer in the case of a Sales Agreement, in which the subject of the service is a non-prefabricated item, manufactured according to the Customer’s specification or serving to satisfy his individual needs.

 

§ 7. COMPLAINTS

  1. If the products have defects that constitute non-compliance with the contract, the customer may file a complaint.
  2. Complaints should be submitted by e-mail to the address biuro@aiduidq.cluster026.hosting.ovh.net by completing the complaint form (available  HERE). When submitting a complaint, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of irregularities and contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Seller.
  3. After receiving the confirmation of receipt of the notification, the customer should send back the advertised goods to the following address: Naturale Elżbieta Sikorska-Molenda, ul. Odkryta 27, 03-140 Warszawa, with the annotation “COMPLAINT”.
  4. As part of the complaint, the Seller does not accept COD shipments.
  5. The customer will receive information about the method of considering the complaint within 14 days from the date of receipt by the Store of the parcel containing the goods complained about.
  6. If the goods have defects, the Customer is entitled to the following claims (Art.556 and Art.561 of the Civil Code):
    1. submitting a declaration of withdrawal from the contract or reduction of the price of the Goods, or
  7. b) requesting the replacement of the Product with a Product free from defects or removal of the defect.
  • If the complaint is not accepted, the goods will be returned to the customer with the refusal of the complaint and its justification.

 

§ 8. INFORMATION CONCERNING SERVICES PROVIDED BY ELECTRONIC MEANS

  1. The store provides the following services to customers by electronic means
    1. a) Enabling the conclusion of on-line contracts for the sale of Goods in the Store in accordance with these Regulations. Such an agreement is concluded for a definite period and is terminated when the Order is placed or the Customer ceases to submit it.
    2. b) Enabling the creation of a Customer account in the Store – an agreement concluded for an indefinite period,
    3. c) Sending the ordered commercial information regarding goods (newsletter) – an agreement concluded for an indefinite period
  2. The Customer is entitled to withdraw from contracts for the sale of Goods in accordance with the relevant legal provisions and on the terms set out in these Regulations. In addition, the Customer is entitled at any time to request the Store to cease providing the services indicated in point 1 (b) and (c) above by sending a relevant request to the Seller, in particular via e-mail to the following address: biuro@aiduidq.cluster026.hosting.ovh.net or in writing to the following address: Naturale Elżbieta Sikorska-Molenda, ul. Odkryta 27, 03-140 Warsaw
  3. The technical conditions for the provision of electronic services by the Store are as follows:
    1. Internet access,
    2. Using a web browser that allows you to edit hypertext documents (such as Internet Explorer, Opera, FireFox or similar),
    3. Having an e-mail account.
  4. Complaints about the services provided by the Store by electronic means may be submitted by sending a complaint to the e-mail address biuro@aiduidq.cluster026.hosting.ovh.net. The customer’s complaint should include the customer’s name and a short description of the complaint. The Store will make every effort to ensure that the reported complaints are considered as soon as possible, but no later than 14 days from the date of receipt of the complaint by the Store. The Customer will be informed about the method of considering the complaint via a message sent to the e-mail address provided by the Customer.

 

§ 9. INTELLECTUAL PROPERTY

  1. All materials, including texts, graphic elements, photos of products, the composition of these elements, trademarks and others, available in the Store are subject to exclusive rights are subject to protection of copyright and industrial property rights.
  2. Any use by anyone, without the express written consent of the Seller, of any of the elements constituting the content and content of the www.alelen.com website constitutes a violation of the Seller’s copyright and results in civil and criminal liability.

 

§ 10. FINAL PROVISIONS

  1. Polish law applies to the contract for the sale of products in the Store. The contract is concluded in Polish.
  2. In matters not covered by these regulations, the provisions of the Civil Code or provisions of other legal acts applicable to the operation and functioning of the store shall apply accordingly.
  3. The competent court for settling disputes is the local court with jurisdiction according to applicable regulations.
  4. The customer may use extrajudicial means of dealing with complaints and redress. In order to take advantage of the possibility of amicable settlement of disputes regarding online purchases, the Customer may submit his complaint, e.g. via the EU ODR internet platform, available at: http://ec.europa.eu/consumers/odr/
  5. reserves the right to amend the Regulations at any time. Amendments to the Regulations apply to orders placed after a given amendment to these Regulations, subject to the provisions of paragraph 2 above.
